EntryCrew – Gatepass & Visitor Management Platform

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Spontaneous Enterprise (OPC) Pvt. Ltd. governing your use of the EntryCrew Application and related services.

By using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as any additional policies referenced herein, including our Privacy Policy.

2. Scope of the Service

EntryCrew provides digital tools and features, including:

• Visitor registration and profiling
• Digital gatepass creation and management
• QR code and ID-based identification
• Approval workflows for visits and meetings
• Check-in and check-out tracking
• Meeting start/end status tracking
• Security verification and logging
• Dashboards, audit trails, and reporting

We reserve the right to modify, enhance, or discontinue any part of the Service at any time, with or without notice.

3. Eligibility & User Obligations

To use EntryCrew, you must:

• Be at least 18 years of age, or
• Be authorized or registered by an Organization that uses EntryCrew

By using the Service, you agree that:

• You will provide accurate, complete, and truthful information.
• You will not impersonate any individual or entity.
• You will not use the Service for unlawful, fraudulent, or malicious purposes.
• You will not attempt to bypass, disable, or interfere with any security-related features of the Service.
• You will not upload, distribute, or transmit malicious code, malware, or harmful content.

4. Organizational Use & Administrative Control

EntryCrew is typically deployed for use by an Organization (such as a company, society, industrial unit, office, or premises operator).

The Organization:

• Controls user onboarding, access, and removal.
• Defines roles, permissions, and approval workflows.
• Determines how long visitor and operational data is retained.
• Is responsible for compliance with applicable laws and regulations.
• Manages and reviews internal user activity and misuse, if any.

Spontaneous is not responsible for internal misuse, unauthorized access, or policy violations occurring within an Organization using the Service.

5. License to Use

Subject to these Terms, Spontaneous grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Application solely for authorized operational and security purposes within your Organization.

You are not permitted to:

• Reverse engineer, decompile, or attempt to extract the source code.
• Copy, modify, distribute, or create derivative works based on the Application.
• Rent, lease, sublicense, or resell the Service or any part thereof.
• Use the Service to develop or support competing products or services.

6. Security & Data Protection

We implement industry-standard security measures intended to protect the integrity and confidentiality of data processed by the Service.

However:

• No system can be guaranteed to be 100% secure.
• You are responsible for maintaining the security of your login credentials and devices.
• We are not liable for breaches or unauthorized access resulting from your negligence, compromised devices, shared credentials, or misuse by you or your Organization.

7. Data Processing & Privacy

Your use of EntryCrew is subject to our Privacy Policy, which explains how we collect, use, and protect personal and operational data.

By using the Service, you consent to the collection and processing of information as described in the Privacy Policy.

8. Permissions & System Access

To function properly, the Application may request access to:

• Camera – for QR code scanning, capturing photos, and document uploads.
• Storage / Files – for uploading ID proofs, documents, and storing or generating gatepass-related content.
• Notifications – for sending approval alerts, visitor arrival notices, and security-related updates.
• Network – for data synchronization and real-time communication.

These permissions are used exclusively for the operation of the Service and not for collecting unrelated or personal data beyond what is necessary.

9. Service Availability & Updates

The Service is provided on an “as-is” and “as-available” basis. We do not guarantee:

• Continuous, uninterrupted access to the Service.
• That all features will be available on all devices or platforms.
• That the Service will be free from errors, defects, or delays.
• Retention of data in the event of failures, outages, or technical issues.

We may release updates, patches, or new versions of the Application. Some updates may be mandatory to continue using the Service.

10. Suspension & Termination

We may suspend or terminate access to the Service if:

• We reasonably believe you have violated these Terms.
• There is suspected fraud, abuse, or security risk.
• The Organization requests revocation of your access.
• We are required to do so by law or regulatory order.

Upon suspension or termination, your right to use the Application ceases immediately. We may disable or delete associated data per our policies and the Organization’s instructions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Spontaneous Enterprise (OPC) Pvt. Ltd. and its directors, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, business, goodwill, or data.
• Errors or inaccuracies in data entered by Users or Organizations, including visitor information and approvals.
• Any unauthorized access, use, or alteration of your data due to factors beyond our reasonable control.
• Any downtime, technical issues, or service interruptions arising from infrastructure, third-party services, or network providers.

Your sole and exclusive remedy for dissatisfaction with the Service is to stop using the Application.

12. Indemnification

You agree to indemnify, defend, and hold harmless Spontaneous:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Any breach of laws or regulations by you or your Organization.
• Any dispute between you and your Organization or third parties relating to data or access.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

14. Changes to These Terms

We may revise these Terms to reflect changes in technology, legal requirements, or business practices. The “Last Updated” date will indicate when changes were made.

Your continued use of the Application after changes are published constitutes acceptance of the updated Terms.
